Terms of service

These Terms and Conditions ("Terms") govern the sale of goods and services between Wanny Store ("we," "us," "our") and you ("Buyer," "you"). By purchasing from Wanny Store, you agree to abide by these Terms to the exclusion of all other terms, prior agreements, or arrangements, and represent that you are purchasing for purposes within your trade, business, or profession.

1. Application of Terms

  • 1.1. Each order placed by the Buyer constitutes an offer to purchase goods or services under these Terms.
  • 1.2. No order will be deemed accepted by Wanny Store until a confirmation of the order is issued, or upon shipment.
  • 1.3. Written quotations provided are valid for 30 calendar days unless otherwise stated. Verbal quotations are advisory and non-binding. All prices are in KES and USD unless otherwise specified.

2. Pricing and Payment

  • 2.1. Prices for our products are as stated at the time of order, subject to changes without prior notice.
  • 2.2. All prices are exclusive of VAT, duties, and shipping charges unless otherwise specified.
  • 2.3. Full payment is required at the time of purchase, which can be made via bank transfer, credit card, or other approved methods. Orders requiring a deposit must be paid in full within five (5) business days of confirmation.

3. Delivery & Acceptance

  • 3.1. Products will be shipped according to DDP (Delivered Duty Paid) terms unless otherwise specified. Title and risk of loss pass to the Buyer upon dispatch from our facility.
  • 3.2. Any estimated delivery dates provided are non-binding. Wanny Store shall not be liable for delays or any resulting losses.
  • 3.3. If products are unavailable, our sole liability is to return any deposit or amount paid for the unavailable product.

4. Cancellation & Returns

  • 4.1. Right of Cancellation: You may cancel the contract up to ten (10) days after receiving the product, provided it remains unused, unopened, and in its original packaging.
  • 4.2. Return Process: To initiate a return, the Buyer must request a Return Merchandise Authorization (RMA). Returned items must reach Wanny Store within ten (10) days of RMA issuance, at the Buyer’s cost, in original packaging.
  • 4.3. Refunds: Refunds will be processed within 30 days of receiving eligible returned items, subject to deductions as outlined below:
    • Restocking Fee: Up to 30% of the original price.
    • Product Condition: A deduction may be applied for damaged products.
    • Shipping Costs: Non-refundable unless we agree otherwise.
  • 4.4. Non-Returnable Products: Items with over 25 hours of use, custom orders, and any product showing signs of use, tampering, or removal of safety seals will not be eligible for returns.

5. Warranties and Repairs

  • 5.1. Warranty: Wanny Store warrants that products are free from defects in material and workmanship for a specified period (detailed on product documentation).
  • 5.2. Warranty Exclusions: This warranty excludes issues caused by:
    • Unauthorized modifications, tampering, or improper use.
    • Physical damage, moisture exposure, electrical issues, and use of non-approved accessories.
    • Cosmetic damage or routine maintenance.
  • 5.3. Repairs: Defective items within the warranty period may be repaired or replaced, at our discretion, upon evaluation.
  • 5.4. Extended Warranty: Extended warranty options, where applicable, are available at additional cost and are non-transferable.

6. Limitation of Liability

  • 6.1. Wanny Store shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with product usage.
  • 6.2. Our total liability is limited to the amount paid by the Buyer for the relevant product.
  • 6.3. Wanny Store will not be responsible for any loss or damage arising from shipping delays or inability to fulfill an order.

7. Indemnification

  • 7.1. The Buyer agrees to indemnify and hold harmless Wanny Store, its officers, and affiliates against any claims or damages arising from the misuse of products or non-compliance with these Terms.

8. Data Protection

  • 8.1. We are committed to protecting your personal data in compliance with applicable data protection laws. By placing an order, you consent to our processing of your information for order fulfillment, customer service, and marketing purposes.

9. Amendments

  • 9.1. Wanny Store reserves the right to modify these Terms without prior notice. Buyers are encouraged to review these Terms periodically to stay informed of any changes.

10. Governing Law

  • 10.1. These Terms are governed by and construed in accordance with the laws of Kenya, without regard to conflicts of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction.
